Early on Sunday morning, a 40-year-old driver was stopped by the police in Kassel after he was driving at excessive speed on the street “Am Auestadion”. The driver demonstrated extremely questionable driving behavior: he ignored red lights twice before the officers called him to order. At the intersection of Ludwig-Mond-Straße and Frankfurter Straße he sped through the red light, although fortunately the intersection was empty at the time. Another road user had to slam on the brakes to avoid a collision. However, the young man gave up after a short chase and drove his Peugeot into a parking lot of a discount store on Tischbeinstrasse, where he was arrested by the police.

A breath alcohol test revealed a dream result: the blood alcohol level was over 2.4. This made the matter clear and the police confiscated the man's driver's license and vehicle. He now has to answer for drunken driving, prohibited motor vehicle racing and endangering road traffic. Such alcohol-impaired driving is not only illegal, but also a danger to all road users.

Alcohol levels and legal consequences

As jusora.de explains, strict rules apply in Germany when it comes to drunk driving. There is an absolute alcohol ban of 0.0‰ for novice drivers, those under 21 and drivers in their probationary period. Anyone caught doing this will face a fine of 250 euros and one point in Flensburg. At a blood alcohol level of 0.3 ‰, the authorities speak of relative unfitness to drive, which can have criminal consequences, while from 0.5 ‰ it is an administrative offense, which results in a fine of 500 euros and two points. From 1.1 ‰ things get serious: This is always a criminal offense, regardless of the driving style.

A value of 1.6 ‰ also means that a medical-psychological examination (MPU) is required to reinstate your driving license. The legal basis on which the police rely includes, among other things, Section 24a StVG and Section 316 StGB, which provide clear guidelines for impaired driving and the revocation of driving licenses in the event of drunk driving.

Drink driving and its consequences

The behavior of the Kassel driver is an example of how important it is to respect the legal requirements. In such cases where the danger caused by drunk driving becomes obvious, the police not only confiscate the vehicle and driver's license, but also initiate criminal proceedings. Road safety is the top priority, and alcohol has no place there.
