Father and son in court: Cannabis case causes a stir in Bad Hersfeld
An interesting scenario occurred in the Bad Hersfeld district court on August 15, 2025, when both father and son from Wolfsburg appeared in court on the same day. The two trials, which were related to drug possession, were accompanied by lawyer Hans Jürgen Hauschild, who was the defense attorney for both. What exactly happened is broken down here.
The 28-year-old son faced charges of possession of just under a kilogram of cannabis resin. At his trial, the prosecutor demanded an eight-month suspended prison sentence. The situation escalated when the son drove with four other people in a car on October 8, 2023, which was supposed to be checked by the police. The driver tried to escape but was later stopped. During the inspection, the officers discovered cannabis and the son came forward as the owner of the backpack that contained the marijuana.
Litigation and judgments
Although the son confessed to the backpack, he was not informed of his status as a suspect. Attorney Hauschild used this argument to claim that the police actions were unlawful. Nevertheless, both the public prosecutor and the lay judge assessed the police's measures as being in accordance with the law. Ultimately, the son was sentenced to a fine of 1,500 euros and the verdict is now final.
The case of the 52-year-old father was different: his case for cannabis possession was dropped. This decision was in connection with an earlier verdict from December 2024, in which he was sentenced to two years probation for drug possession and trafficking. A co-defendant, a 25-year-old man who possessed 125 grams of amphetamine, received a suspended sentence of eight months.
Jurisprudence in drug policy
A key issue brought to light by this case is the need for proper instruction from police once someone is considered a suspect. This legal detail plays an important role in the evaluation of drug cases. The interpretations and decisions of the courts show the complex relationship between the police, the judiciary and the accused people.
This incident could raise questions among the public about what happens next with such criminal offenses and whether the punishments are proportionate to the crime. What is certain is that such events fuel the discussion about drug policy and legal frameworks.
