Judgment strengthens online banking rights for supervised people in the Rhineland!
What a win for consumer protection! A current judgment of the Düsseldorf Higher Regional Court has significantly improved the legal situation for supervised people in relation to online banking. The lawsuit was submitted by the protective community for bank customers, investors and policyholder e.V. and highlights important grievances in dealing with banks with their clients who are legally supervised. The main criticisms included the repeated submission of original powers at any order and the refusal to grant access to online banking for these supervised people. Before the judgment, supervisors were forced to present original documents again in each transaction and often cover long distances to the branch - from 16 to 27 kilometers.
Thanks to the agreement between the parties, however, movement is now moving. Access for supervisors to online banking was strengthened by the court, which means that they no longer have to present the original powers every time. This not only saves time, but also saves the numerous trips to the bank.
price -worth equal treatment
The court also found that there was a ban on discrimination against payment accounts. The bank could not cite any convincing reasons for refusing online access for supervised people. A change in the law that came into force on January 1, 2023 made the former arguments of the bank obsolete. Another point that underpins the judgment is to determine that supervisors must not be denied access to online banking on the basis of a lack of information on the residential address. The court was unable to agree with the bank in this regard and emphasized that the presentation of an official ID is required for all business partners regardless of the supervisor situation.
This judgment puts the equal treatment of all customers in the foreground. It is also important to observe the binding regulations of the money laundering law, which must not be neglected. The decision enormously strengthens the rights of supervised people in digital payment transactions, which has become partially successful for consumers.
liability and security in online banking
Another important judgment that strengthens the position of consumers in online banking comes from the Federal Court of Justice. This was about unauthorized debit, which were carried out despite a safe TAN procedure. In this case, the court decided in favor of the consumer and found that the bank is liable for such processes if it cannot prove that the customer acted negligently. The judgment underlines how important it is that banks design their security procedures in such a way that they protect against unauthorized transactions.
Overall, these developments show that consumer rights are very popular in digital financial traffic and that legal care structures can also be made more useful in the digital world.
